DEFINITIONS.<br \/>\n4 For purposes of this Act\u2014<br \/>\n5 (1) the term \u2018\u2018domain name\u2019\u2019 has the same<br \/>\n6 meaning as in section 45 of the Lanham Act (15<br \/>\n7 U.S.C. 1127);<br \/>\n8 (2) the term \u2018\u2018domain name system server\u2019\u2019<br \/>\n9 means a server or other mechanism used to provide<br \/>\n10 the Internet protocol address associated with a do-<br \/>\n11 main name;<br \/>\n12 (3) the term \u2018\u2018financial transaction provider\u2019\u2019<br \/>\n13 has the same meaning as in section 5362(4) of title<br \/>\n14 31, United States Code;<br \/>\n15 (4) the term \u2018\u2018information location tool\u2019\u2019 has the<br \/>\n16 same meaning as described in subsection (d) of sec-<br \/>\n17 tion 512 of title 17, United States Code;<br \/>\n18 (5) the term \u2018\u2018Internet advertising service\u2019\u2019<br \/>\n19 means a service that for compensation sells, pur-<br \/>\n20 chases, brokers, serves, inserts, verifies, or clears the<br \/>\n21 placement of an advertisement, including a paid or<br \/>\n22 sponsored search result, link, or placement that is<br \/>\n23 rendered in viewable form for any period of time on<br \/>\n24 an Internet site;<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS3<br \/>\n\u2022S 968 RS<br \/>\n1 (6) the term \u2018\u2018Internet site\u2019\u2019 means the collec-<br \/>\n2 tion of digital assets, including links, indexes, or<br \/>\n3 pointers to digital assets, accessible through the<br \/>\n4 Internet that are addressed relative to a common do-<br \/>\n5 main name;<br \/>\n6 (7) the term \u2018\u2018Internet site dedicated to infring-<br \/>\n7 ing activities\u2019\u2019 means an Internet site that\u2014<br \/>\n8 (A) has no significant use other than en-<br \/>\n9 gaging in, enabling, or facilitating the\u2014<br \/>\n10 (i) reproduction, distribution, or pub-<br \/>\n11 lic performance of copyrighted works, in<br \/>\n12 complete or substantially complete form, in<br \/>\n13 a manner that constitutes copyright in-<br \/>\n14 fringement under section 501 of title 17,<br \/>\n15 United States Code;<br \/>\n16 (ii) violation of section 1201 of title<br \/>\n17 17, United States Code; or<br \/>\n18 (iii) sale, distribution, or promotion of<br \/>\n19 goods, services, or materials bearing a<br \/>\n20 counterfeit mark, as that term is defined<br \/>\n21 in section 34(d) of the Lanham Act; or<br \/>\n22 (B) is designed, operated, or marketed by<br \/>\n23 its operator or persons operating in concert<br \/>\n24 with the operator, and facts or circumstances<br \/>\n25 suggest is used, primarily as a means for enVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS4<br \/>\n\u2022S 968 RS<br \/>\n1 gaging in, enabling, or facilitating the activities<br \/>\n2 described under clauses (i), (ii), or (iii) of sub-<br \/>\n3 paragraph (A);<br \/>\n4 (8) the term \u2018\u2018Lanham Act\u2019\u2019 means the Act en-<br \/>\n5 titled \u2018\u2018An Act to provide for the registration and<br \/>\n6 protection of trademarks used in commerce, to carry<br \/>\n7 out the provisions of certain international conven-<br \/>\n8 tions, and for other purposes\u2019\u2019, approved July 5,<br \/>\n9 1946 (commonly referred to as the \u2018\u2018Trademark Act<br \/>\n10 of 1946\u2019\u2019 or the \u2018\u2018Lanham Act\u2019\u2019);<br \/>\n11 (9) the term \u2018\u2018nondomestic domain name\u2019\u2019<br \/>\n12 means a domain name for which the domain name<br \/>\n13 registry that issued the domain name and operates<br \/>\n14 the relevant top level domain, and the domain name<br \/>\n15 registrar for the domain name, are not located in the<br \/>\n16 United States;<br \/>\n17 (10) the term \u2018\u2018owner\u2019\u2019 or \u2018\u2018operator\u2019\u2019 when<br \/>\n18 used in connection with an Internet site shall in-<br \/>\n19 clude, respectively, any owner of a majority interest<br \/>\n20 in, or any person with authority to operate, such<br \/>\n21 Internet site; and<br \/>\n22 (11) the term \u2018\u2018qualifying plaintiff\u2019\u2019 means\u2014<br \/>\n23 (A) the Attorney General of the United<br \/>\n24 States; or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS5<br \/>\n\u2022S 968 RS<br \/>\n1 (B) an owner of an intellectual property<br \/>\n2 right, or one authorized to enforce such right,<br \/>\n3 harmed by the activities of an Internet site<br \/>\n4 dedicated to infringing activities occurring on<br \/>\n5 that Internet site.<br \/>\n6 SEC. 3. ENHANCING ENFORCEMENT AGAINST ROGUE<br \/>\n7 WEBSITES OPERATED AND REGISTERED<br \/>\n8 OVERSEAS.<br \/>\n9 (a) COMMENCEMENT OF AN ACTION.\u2014<br \/>\n10 (1) IN PERSONAM.\u2014The Attorney General may<br \/>\n11 commence an in personam action against\u2014<br \/>\n12 (A) a registrant of a nondomestic domain<br \/>\n13 name used by an Internet site dedicated to in-<br \/>\n14 fringing activities; or<br \/>\n15 (B) an owner or operator of an Internet<br \/>\n16 site dedicated to infringing activities accessed<br \/>\n17 through a nondomestic domain name.<br \/>\n18 (2) IN REM.\u2014If through due diligence the At-<br \/>\n19 torney General is unable to find a person described<br \/>\n20 in subparagraphs (A) or (B) of paragraph (1), or no<br \/>\n21 such person found has an address within a judicial<br \/>\n22 district of the United States, the Attorney General<br \/>\n23 may commence an in rem action against a non-<br \/>\n24 domestic domain name used by an Internet site dedi-<br \/>\n25 cated to infringing activities.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS6<br \/>\n\u2022S 968 RS<br \/>\n1 (b) ORDERS OF THE COURT.\u2014<br \/>\n2 (1) IN GENERAL.\u2014On application of the Attor-<br \/>\n3 ney General following the commencement of an ac-<br \/>\n4 tion under this section, the court may issue a tem-<br \/>\n5 porary restraining order, a preliminary injunction, or<br \/>\n6 an injunction, in accordance with rule 65 of the Fed-<br \/>\n7 eral Rules of Civil Procedure, against the non-<br \/>\n8 domestic domain name used by an Internet site dedi-<br \/>\n9 cated to infringing activities, or against a registrant<br \/>\n10 of such domain name, or the owner or operator of<br \/>\n11 such Internet site dedicated to infringing activities,<br \/>\n12 to cease and desist from undertaking any further ac-<br \/>\n13 tivity as an Internet site dedicated to infringing ac-<br \/>\n14 tivities, if\u2014<br \/>\n15 (A) the domain name is used within the<br \/>\n16 United States to access such Internet site; and<br \/>\n17 (B) the Internet site\u2014<br \/>\n18 (i) conducts business directed to resi-<br \/>\n19 dents of the United States; and<br \/>\n20 (ii) harms holders of United States in-<br \/>\n21 tellectual property rights.<br \/>\n22 (2) DETERMINATION BY THE COURT.\u2014For pur-<br \/>\n23 poses of determining whether an Internet site con-<br \/>\n24 ducts business directed to residents of the United<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS7<br \/>\n\u2022S 968 RS<br \/>\n1 States under paragraph (1)(B)(i), a court may con-<br \/>\n2 sider, among other indicia, whether\u2014<br \/>\n3 (A) the Internet site is providing goods or<br \/>\n4 services described in section 2(7) to users lo-<br \/>\n5 cated in the United States;<br \/>\n6 (B) there is evidence that the Internet site<br \/>\n7 is not intended to provide\u2014<br \/>\n8 (i) such goods and services to users<br \/>\n9 located in the United States;<br \/>\n10 (ii) access to such goods and services<br \/>\n11 to users located in the United States; and<br \/>\n12 (iii) delivery of such goods and serv-<br \/>\n13 ices to users located in the United States;<br \/>\n14 (C) the Internet site has reasonable meas-<br \/>\n15 ures in place to prevent such goods and services<br \/>\n16 from being accessed from or delivered to the<br \/>\n17 United States;<br \/>\n18 (D) the Internet site offers services ob-<br \/>\n19 tained in the United States; and<br \/>\n20 (E) any prices for goods and services are<br \/>\n21 indicated in the currency of the United States.<br \/>\n22 (c) NOTICE AND SERVICE OF PROCESS.\u2014<br \/>\n23 (1) IN GENERAL.\u2014Upon commencing an action<br \/>\n24 under this section, the Attorney General shall send<br \/>\n25 a notice of the alleged violation and intent to proVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS8<br \/>\n\u2022S 968 RS<br \/>\n1 ceed under this Act to the registrant of the domain<br \/>\n2 name of the Internet site\u2014<br \/>\n3 (A) at the postal and e-mail address ap-<br \/>\n4 pearing in the applicable publicly accessible<br \/>\n5 database of registrations, if any and to the ex-<br \/>\n6 tent such addresses are reasonably available;<br \/>\n7 (B) via the postal and e-mail address of<br \/>\n8 the registrar, registry, or other domain name<br \/>\n9 registration authority that registered or as-<br \/>\n10 signed the domain name, to the extent such ad-<br \/>\n11 dresses are reasonably available; and<br \/>\n12 (C) in any other such form as the court<br \/>\n13 finds necessary, including as may be required<br \/>\n14 by Rule 4(f) of the Federal Rules of Civil Pro-<br \/>\n15 cedure.<br \/>\n16 (2) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n17 this section, the actions described in this subsection<br \/>\n18 shall constitute service of process.<br \/>\n19 (d) REQUIRED ACTIONS BASED ON COURT OR-<br \/>\n20 DERS.\u2014<br \/>\n21 (1) SERVICE.\u2014A Federal law enforcement offi-<br \/>\n22 cer, with the prior approval of the court, may serve<br \/>\n23 a copy of a court order issued pursuant to this sec-<br \/>\n24 tion on similarly situated entities within each class<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS9<br \/>\n\u2022S 968 RS<br \/>\n1 described in paragraph (2). Proof of service shall be<br \/>\n2 filed with the court.<br \/>\n3 (2) REASONABLE MEASURES.\u2014After being<br \/>\n4 served with a copy of an order pursuant to this sub-<br \/>\n5 section:<br \/>\n6 (A) OPERATORS.\u2014<br \/>\n7 (i) IN GENERAL.\u2014An operator of a<br \/>\n8 nonauthoritative domain name system<br \/>\n9 server shall take the least burdensome<br \/>\n10 technically feasible and reasonable meas-<br \/>\n11 ures designed to prevent the domain name<br \/>\n12 described in the order from resolving to<br \/>\n13 that domain name\u2019s Internet protocol ad-<br \/>\n14 dress, except that\u2014<br \/>\n15 (I) such operator shall not be re-<br \/>\n16 quired\u2014<br \/>\n17 (aa) other than as directed<br \/>\n18 under this subparagraph, to mod-<br \/>\n19 ify its network, software, sys-<br \/>\n20 tems, or facilities;<br \/>\n21 (bb) to take any measures<br \/>\n22 with respect to domain name<br \/>\n23 lookups not performed by its own<br \/>\n24 domain name server or domain<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS10<br \/>\n\u2022S 968 RS<br \/>\n1 name system servers located out-<br \/>\n2 side the United States; or<br \/>\n3 (cc) to continue to prevent<br \/>\n4 access to a domain name to<br \/>\n5 which access has been effectively<br \/>\n6 disable by other means; and<br \/>\n7 (II) nothing in this subparagraph<br \/>\n8 shall affect the limitation on the liabil-<br \/>\n9 ity of such an operator under section<br \/>\n10 512 of title 17, United States Code.<br \/>\n11 (ii) TEXT OF NOTICE.\u2014The Attorney<br \/>\n12 General shall prescribe the text of the no-<br \/>\n13 tice displayed to users or customers of an<br \/>\n14 operator taking an action pursuant to this<br \/>\n15 subparagraph. Such text shall specify that<br \/>\n16 the action is being taken pursuant to a<br \/>\n17 court order obtained by the Attorney Gen-<br \/>\n18 eral.<br \/>\n19 (B) FINANCIAL TRANSACTION PRO-<br \/>\n20 VIDERS.\u2014A financial transaction provider shall<br \/>\n21 take reasonable measures, as expeditiously as<br \/>\n22 reasonable, designed to prevent, prohibit, or<br \/>\n23 suspend its service from completing payment<br \/>\n24 transactions involving customers located within<br \/>\n25 the United States and the Internet site associVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS11<br \/>\n\u2022S 968 RS<br \/>\n1 ated with the domain name set forth in the<br \/>\n2 order.<br \/>\n3 (C) INTERNET ADVERTISING SERVICES.\u2014<br \/>\n4 An Internet advertising service that contracts<br \/>\n5 with the Internet site associated with the do-<br \/>\n6 main name set forth in the order to provide ad-<br \/>\n7 vertising to or for that site, or which knowingly<br \/>\n8 serves advertising to or for such site, shall take<br \/>\n9 technically feasible and reasonable measures, as<br \/>\n10 expeditiously as reasonable, designed to\u2014<br \/>\n11 (i) prevent its service from providing<br \/>\n12 advertisements to the Internet site associ-<br \/>\n13 ated with such domain name; or<br \/>\n14 (ii) cease making available advertise-<br \/>\n15 ments for that site, or paid or sponsored<br \/>\n16 search results, links or other placements<br \/>\n17 that provide access to the domain name.<br \/>\n18 (D) INFORMATION LOCATION TOOLS.\u2014An<br \/>\n19 information location tool shall take technically<br \/>\n20 feasible and reasonable measures, as expedi-<br \/>\n21 tiously as possible, to\u2014<br \/>\n22 (i) remove or disable access to the<br \/>\n23 Internet site associated with the domain<br \/>\n24 name set forth in the order; or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS12<br \/>\n\u2022S 968 RS<br \/>\n1 (ii) not serve a hypertext link to such<br \/>\n2 Internet site.<br \/>\n3 (3) COMMUNICATION WITH USERS.\u2014Except as<br \/>\n4 provided under paragraph (2)(A)(ii), an entity tak-<br \/>\n5 ing an action described in this subsection shall de-<br \/>\n6 termine whether and how to communicate such ac-<br \/>\n7 tion to the entity\u2019s users or customers.<br \/>\n8 (4) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n9 an action commenced under this section, the obliga-<br \/>\n10 tions of an entity described in this subsection shall<br \/>\n11 be limited to the actions set out in each paragraph<br \/>\n12 or subparagraph applicable to such entity, and no<br \/>\n13 order issued pursuant to this section shall impose<br \/>\n14 any additional obligations on, or require additional<br \/>\n15 actions by, such entity.<br \/>\n16 (5) ACTIONS PURSUANT TO COURT ORDER.\u2014<br \/>\n17 (A) IMMUNITY FROM SUIT.\u2014No cause of<br \/>\n18 action shall lie in any Federal or State court or<br \/>\n19 administrative agency against any entity receiv-<br \/>\n20 ing a court order issued under this subsection,<br \/>\n21 or against any director, officer, employee, or<br \/>\n22 agent thereof, for any act reasonably designed<br \/>\n23 to comply with this subsection or reasonably<br \/>\n24 arising from such order, other than in an action<br \/>\n25 pursuant to subsection (e).<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS13<br \/>\n\u2022S 968 RS<br \/>\n1 (B) IMMUNITY FROM LIABILITY.\u2014Any en-<br \/>\n2 tity receiving an order under this subsection,<br \/>\n3 and any director, officer, employee, or agent<br \/>\n4 thereof, shall not be liable to any party for any<br \/>\n5 acts reasonably designed to comply with this<br \/>\n6 subsection or reasonably arising from such<br \/>\n7 order, other than in an action pursuant to sub-<br \/>\n8 section (e), and any actions taken by customers<br \/>\n9 of such entity to circumvent any restriction on<br \/>\n10 access to the Internet domain instituted pursu-<br \/>\n11 ant to this subsection or any act, failure, or in-<br \/>\n12 ability to restrict access to an Internet domain<br \/>\n13 that is the subject of a court order issued pur-<br \/>\n14 suant to this subsection despite good faith ef-<br \/>\n15 forts to do so by such entity shall not be used<br \/>\n16 by any person in any claim or cause of action<br \/>\n17 against such entity, other than in an action<br \/>\n18 pursuant to subsection (e).<br \/>\n19 (e) ENFORCEMENT OF ORDERS.\u2014<br \/>\n20 (1) IN GENERAL.\u2014In order to compel compli-<br \/>\n21 ance with this section, the Attorney General may<br \/>\n22 bring an action for injunctive relief against any<br \/>\n23 party receiving a court order issued pursuant to this<br \/>\n24 section that knowingly and willfully fails to comply<br \/>\n25 with such order.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00013 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS14<br \/>\n\u2022S 968 RS<br \/>\n1 (2) RULE OF CONSTRUCTION.\u2014The authority<br \/>\n2 granted the Attorney General under paragraph (1)<br \/>\n3 shall be the sole legal remedy for enforcing the obli-<br \/>\n4 gations under this section of any entity described in<br \/>\n5 subsection (d).<br \/>\n6 (3) DEFENSE.\u2014A defendant in an action under<br \/>\n7 paragraph (1) may establish an affirmative defense<br \/>\n8 by showing that the defendant does not have the<br \/>\n9 technical means to comply with the subsection with-<br \/>\n10 out incurring an unreasonable economic burden, or<br \/>\n11 that the order is inconsistent with this Act. ELIMINATING THE FINANCIAL INCENTIVE TO STEAL<br \/>\n4 INTELLECTUAL PROPERTY ONLINE.<br \/>\n5 (a) COMMENCEMENT OF AN ACTION.\u2014<br \/>\n6 (1) IN PERSONAM.\u2014A qualifying plaintiff may<br \/>\n7 commence an in personam action against\u2014<br \/>\n8 (A) a registrant of a domain name used by<br \/>\n9 an Internet site dedicated to infringing activi-<br \/>\n10 ties; or<br \/>\n11 (B) an owner or operator of an Internet<br \/>\n12 site dedicated to infringing activities accessed<br \/>\n13 through a domain name.<br \/>\n14 (2) IN REM.\u2014If through due diligence a quali-<br \/>\n15 fying plaintiff is unable to find a person described<br \/>\n16 in subparagraphs (A) or (B) of paragraph (1), or no<br \/>\n17 such person found has an address within a judicial<br \/>\n18 district of the United States, the Attorney General<br \/>\n19 may commence an in rem action against a domain<br \/>\n20 name used by an Internet site dedicated to infring-<br \/>\n21 ing activities.<br \/>\n22 (b) ORDERS OF THE COURT.\u2014<br \/>\n23 (1) IN GENERAL.\u2014On application of a quali-<br \/>\n24 fying plaintiff following the commencement of an ac-<br \/>\n25 tion under this section, the court may issue a temVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00016 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS17<br \/>\n\u2022S 968 RS<br \/>\n1 porary restraining order, a preliminary injunction, or<br \/>\n2 an injunction, in accordance with rule 65 of the Fed-<br \/>\n3 eral Rules of Civil Procedure, against the domain<br \/>\n4 name used by an Internet site dedicated to infring-<br \/>\n5 ing activities, or against a registrant of such domain<br \/>\n6 name, or the owner or operator of such Internet site<br \/>\n7 dedicated to infringing activities, to cease and desist<br \/>\n8 from undertaking any further activity as an Internet<br \/>\n9 site dedicated to infringing activities, if\u2014<br \/>\n10 (A) the domain name is registered or as-<br \/>\n11 signed by a domain name registrar or domain<br \/>\n12 name registry that located or doing business in<br \/>\n13 the United States; or<br \/>\n14 (B)(i) the domain name is used within the<br \/>\n15 United States to access such Internet site; and<br \/>\n16 (ii) the Internet site\u2014<br \/>\n17 (I) conducts business directed to resi-<br \/>\n18 dents of the United States; and<br \/>\n19 (II) harms holders of United States<br \/>\n20 intellectual property rights.<br \/>\n21 (2) DETERMINATION BY THE COURT.\u2014For pur-<br \/>\n22 poses of determining whether an Internet site con-<br \/>\n23 ducts business directed to residents of the United<br \/>\n24 States under paragraph (1)(B)(ii)(I), a court may<br \/>\n25 consider, among other indicia, whether\u2014<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS18<br \/>\n\u2022S 968 RS<br \/>\n1 (A) the Internet site is providing goods or<br \/>\n2 services described in section 2(7) to users lo-<br \/>\n3 cated in the United States;<br \/>\n4 (B) there is evidence that the Internet site<br \/>\n5 is not intended to provide\u2014<br \/>\n6 (i) such goods and services to users<br \/>\n7 located in the United States;<br \/>\n8 (ii) access to such goods and services<br \/>\n9 to users located in the United States; and<br \/>\n10 (iii) delivery of such goods and serv-<br \/>\n11 ices to users located in the United States;<br \/>\n12 (C) the Internet site has reasonable meas-<br \/>\n13 ures in place to prevent such goods and services<br \/>\n14 from being accessed from or delivered to the<br \/>\n15 United States;<br \/>\n16 (D) the Internet site offers services ob-<br \/>\n17 tained in the United States; and<br \/>\n18 (E) any prices for goods and services are<br \/>\n19 indicated in the currency of the United States.<br \/>\n20 (c) NOTICE AND SERVICE OF PROCESS.\u2014<br \/>\n21 (1) IN GENERAL.\u2014Upon commencing an action<br \/>\n22 under this section, the qualifying plaintiff shall send<br \/>\n23 a notice of the alleged violation and intent to pro-<br \/>\n24 ceed under this Act to the registrant of the domain<br \/>\n25 name of the Internet site\u2014<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00018 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS19<br \/>\n\u2022S 968 RS<br \/>\n1 (A) at the postal and e-mail address ap-<br \/>\n2 pearing in the applicable publicly accessible<br \/>\n3 database of registrations, if any and to the ex-<br \/>\n4 tent such addresses are reasonably available;<br \/>\n5 (B) via the postal and e-mail address of<br \/>\n6 the registrar, registry, or other domain name<br \/>\n7 registration authority that registered or as-<br \/>\n8 signed the domain name, to the extent such ad-<br \/>\n9 dresses are reasonably available; and<br \/>\n10 (C) in any other such form as the court<br \/>\n11 finds necessary, including as may be required<br \/>\n12 by Rule 4(f) of the Federal Rules of Civil Pro-<br \/>\n13 cedure.<br \/>\n14 (2) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n15 this section, the actions described in this subsection<br \/>\n16 shall constitute service of process.<br \/>\n17 (d) REQUIRED ACTIONS BASED ON COURT OR-<br \/>\n18 DERS.\u2014<br \/>\n19 (1) SERVICE.\u2014A qualifying plaintiff, with the<br \/>\n20 prior approval of the court, may, serve a copy of a<br \/>\n21 court order issued pursuant to this section on simi-<br \/>\n22 larly situated entities within each class described in<br \/>\n23 paragraph (2). Proof of service shall be filed with<br \/>\n24 the court.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00019 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS20<br \/>\n\u2022S 968 RS<br \/>\n1 (2) REASONABLE MEASURES.\u2014After being<br \/>\n2 served with a copy of an order pursuant to this sub-<br \/>\n3 section:<br \/>\n4 (A) FINANCIAL TRANSACTION PRO-<br \/>\n5 VIDERS.\u2014A financial transaction provider shall<br \/>\n6 take reasonable measures, as expeditiously as<br \/>\n7 reasonable, designed to prevent, prohibit, or<br \/>\n8 suspend its service from completing payment<br \/>\n9 transactions involving customers located within<br \/>\n10 the United States and the Internet site associ-<br \/>\n11 ated with the domain name set forth in the<br \/>\n12 order.<br \/>\n13 (B) INTERNET ADVERTISING SERVICES.\u2014<br \/>\n14 An Internet advertising service that contracts<br \/>\n15 with the Internet site associated with the do-<br \/>\n16 main name set forth in the order to provide ad-<br \/>\n17 vertising to or for that site, or which knowingly<br \/>\n18 serves advertising to or for such site, shall take<br \/>\n19 technically feasible and reasonable measures, as<br \/>\n20 expeditiously as reasonable, designed to\u2014<br \/>\n21 (i) prevent its service from providing<br \/>\n22 advertisements to the Internet site associ-<br \/>\n23 ated with such domain name; or<br \/>\n24 (ii) cease making available advertise-<br \/>\n25 ments for that site, or paid or sponsored<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00020 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS21<br \/>\n\u2022S 968 RS<br \/>\n1 search results, links, or placements that<br \/>\n2 provide access to the domain name.<br \/>\n3 (3) COMMUNICATION WITH USERS.\u2014An entity<br \/>\n4 taking an action described in this subsection shall<br \/>\n5 determine how to communicate such action to the<br \/>\n6 entity\u2019s users or customers.<br \/>\n7 (4) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n8 an action commenced under this section, the obliga-<br \/>\n9 tions of an entity described in this subsection shall<br \/>\n10 be limited to the actions set out in each paragraph<br \/>\n11 or subparagraph applicable to such entity, and no<br \/>\n12 order issued pursuant to this section shall impose<br \/>\n13 any additional obligations on, or require additional<br \/>\n14 actions by, such entity.<br \/>\n15 (5) ACTIONS PURSUANT TO COURT ORDER.\u2014<br \/>\n16 (A) IMMUNITY FROM SUIT.\u2014No cause of<br \/>\n17 action shall lie in any Federal or State court or<br \/>\n18 administrative agency against any entity receiv-<br \/>\n19 ing a court order issued under this subsection,<br \/>\n20 or against any director, officer, employee, or<br \/>\n21 agent thereof, for any act reasonably designed<br \/>\n22 to comply with this subsection or reasonably<br \/>\n23 arising from such order, other than in an action<br \/>\n24 pursuant to subsection (e).<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00021 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS22<br \/>\n\u2022S 968 RS<br \/>\n1 (B) IMMUNITY FROM LIABILITY.\u2014Any en-<br \/>\n2 tity receiving an order under this subsection,<br \/>\n3 and any director, officer, employee, or agent<br \/>\n4 thereof, shall not be liable to any party for any<br \/>\n5 acts reasonably designed to comply with this<br \/>\n6 subsection or reasonably arising from such<br \/>\n7 order, other than in an action pursuant to sub-<br \/>\n8 section (e), and any actions taken by customers<br \/>\n9 of such entity to circumvent any restriction on<br \/>\n10 access to the Internet domain instituted pursu-<br \/>\n11 ant to this subsection or any act, failure, or in-<br \/>\n12 ability to restrict access to an Internet domain<br \/>\n13 that is the subject of a court order issued pur-<br \/>\n14 suant to this subsection despite good faith ef-<br \/>\n15 forts to do so by such entity shall not be used<br \/>\n16 by any person in any claim or cause of action<br \/>\n17 against such entity, other than in an action<br \/>\n18 pursuant to subsection (e).<br \/>\n19 (e) ENFORCEMENT OF ORDERS.\u2014<br \/>\n20 (1) IN GENERAL.\u2014In order to compel compli-<br \/>\n21 ance with this section, the qualifying plaintiff may<br \/>\n22 bring an action for injunctive relief against any<br \/>\n23 party receiving a court order issued pursuant to this<br \/>\n24 section that knowingly and willfully fails to comply<br \/>\n25 with such order.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00022 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS23<br \/>\n\u2022S 968 RS<br \/>\n1 (2) RULE OF CONSTRUCTION.\u2014The authority<br \/>\n2 granted a qualifying plaintiff under paragraph (1)<br \/>\n3 shall be the sole legal remedy for enforcing the obli-<br \/>\n4 gations under this section of any entity described in<br \/>\n5 subsection (d).<br \/>\n6 (3) DEFENSE.\u2014A defendant in an action com-<br \/>\n7 menced under paragraph (1) may establish an af-<br \/>\n8 firmative defense by showing that the defendant<br \/>\n9 does not have the technical means to comply with<br \/>\n10 the subsection without incurring an unreasonable<br \/>\n11 economic burden, or that the order is inconsistent<br \/>\n12 with this Act. VOLUNTARY ACTION AGAINST WEBSITES STEALING<br \/>\n4 AMERICAN INTELLECTUAL PROPERTY.<br \/>\n5 (a) IN GENERAL.\u2014No financial transaction provider<br \/>\n6 or Internet advertising service shall be liable for damages<br \/>\n7 to any person for voluntarily taking any action described<br \/>\n8 in section 3(d) or 4(d) with regard to an Internet site if<br \/>\n9 the entity acting in good faith and based on credible evi-<br \/>\n10 dence has a reasonable belief that the Internet site is an<br \/>\n11 Internet site dedicated to infringing activities.<br \/>\n12 (b) INTERNET SITES ENGAGED IN INFRINGING AC-<br \/>\n13 TIVITIES THAT ENDANGER THE PUBLIC HEALTH.\u2014<br \/>\n14 (1) REFUSAL OF SERVICE.\u2014A domain name<br \/>\n15 registry, domain name registrar, financial trans-<br \/>\n16 action provider, information location tool, or Inter-<br \/>\n17 net advertising service, acting in good faith and<br \/>\n18 based on credible evidence, may stop providing or<br \/>\n19 refuse to provide services to an infringing Internet<br \/>\n20 site that endangers the public health.<br \/>\n21 (2) IMMUNITY FROM LIABILITY.\u2014An entity de-<br \/>\n22 scribed in paragraph (1), including its directors, offi-<br \/>\n23 cers, employees, or agents, that ceases or refused to<br \/>\n24 provide services under paragraph (1) shall not be<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00025 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS26<br \/>\n\u2022S 968 RS<br \/>\n1 liable to any party under any Federal or State law<br \/>\n2 for such action.<br \/>\n3 (3) DEFINITIONS.\u2014For purposes of this sub-<br \/>\n4 section\u2014<br \/>\n5 (A) the term \u2018\u2018adulterated\u2019\u2019 has the same<br \/>\n6 meaning as in section 501 of the Federal Food,<br \/>\n7 Drug, and Cosmetic Act (21 U.S.C. 351);<br \/>\n8 (B) an \u2018\u2018infringing Internet site that en-<br \/>\n9 dangers the public health\u2019\u2019 means\u2014<br \/>\n10 (i) an Internet site dedicated to in-<br \/>\n11 fringing activities for which the counterfeit<br \/>\n12 products that it offers, sells, dispenses, or<br \/>\n13 distributes are controlled or non-controlled<br \/>\n14 prescription medication; or<br \/>\n15 (ii) an Internet site that has no sig-<br \/>\n16 nificant use other than, or is designed, op-<br \/>\n17 erated, or marketed by its operator or per-<br \/>\n18 sons operating in concert with the oper-<br \/>\n19 ator, and facts or circumstances suggest is<br \/>\n20 used, primarily as a means for\u2014<br \/>\n21 (I) offering, selling, dispensing,<br \/>\n22 or distributing any controlled or non-<br \/>\n23 controlled prescription medication,<br \/>\n24 and does so regularly without a valid<br \/>\n25 prescription; or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00026 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS27<br \/>\n\u2022S 968 RS<br \/>\n1 (II) offering, selling, dispensing,<br \/>\n2 or distributing any controlled or non-<br \/>\n3 controlled prescription medication,<br \/>\n4 and does so regularly for medication<br \/>\n5 that is adulterated or misbranded;<br \/>\n6 (C) the term \u2018\u2018misbranded\u2019\u2019 has the same<br \/>\n7 meaning as in section 502 of the Federal Food,<br \/>\n8 Drug, and Cosmetic Act (21 U.S.C. 352); and<br \/>\n9 (D) the term \u2018\u2018valid prescription\u2019\u2019 has the<br \/>\n10 same meaning as in section 309(e)(2)(A) of the<br \/>\n11 Controlled Substances Act (21 U.S.C.<br \/>\n12 829(e)(2)(A)).<br \/>\n13 SEC. 6. SAVINGS CLAUSES.<br \/>\n14 (a) RULE OF CONSTRUCTION RELATING TO CIVIL<br \/>\n15 AND CRIMINAL REMEDIES.\u2014Nothing in this Act shall be<br \/>\n16 construed to limit or expand civil or criminal remedies<br \/>\n17 available to any person (including the United States) for<br \/>\n18 infringing activities on the Internet pursuant to any other<br \/>\n19 Federal or State law.<br \/>\n20 (b) RULE OF CONSTRUCTION RELATING TO VICARI-<br \/>\n21 OUS OR CONTRIBUTORY LIABILITY.\u2014Nothing in this Act<br \/>\n22 shall be construed to enlarge or diminish vicarious or con-<br \/>\n23 tributory liability for any cause of action available under<br \/>\n24 title 17, United States Code, including any limitations on<br \/>\n25 liability under section 512 of such title 17, or to create<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00027 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS28<br \/>\n\u2022S 968 RS<br \/>\n1 an obligation to take action pursuant to section 5 of this<br \/>\n2 Act.<br \/>\n3 (c) RELATIONSHIP WITH SECTION 512 OF TITLE<br \/>\n4 17.\u2014Nothing in this Act, and no order issued or served<br \/>\n5 pursuant to sections 3 or 4 of this Act, shall serve as a<br \/>\n6 basis for determining the application of section 512 of title<br \/>\n7 17, United States Code.<br \/>\n8 SEC. 7. GUIDELINES AND STUDIES.<br \/>\n9 (a) GUIDELINES.\u2014The Attorney General shall\u2014<br \/>\n10 (1) publish procedures developed in consultation<br \/>\n11 with other relevant law enforcement agencies, includ-<br \/>\n12 ing the United States Immigration and Customs En-<br \/>\n13 forcement, to receive information from the public<br \/>\n14 about Internet sites dedicated to infringing activi-<br \/>\n15 ties;<br \/>\n16 (2) provide guidance to intellectual property<br \/>\n17 rights holders about what information such rights<br \/>\n18 holders should provide law enforcement agencies to<br \/>\n19 initiate an investigation pursuant to this Act;<br \/>\n20 (3) provide guidance to intellectual property<br \/>\n21 rights holders about how to supplement an ongoing<br \/>\n22 investigation initiated pursuant to this Act;<br \/>\n23 (4) establish standards for prioritization of ac-<br \/>\n24 tions brought under this Act;<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00028 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS29<br \/>\n\u2022S 968 RS<br \/>\n1 (5) provide appropriate resources and proce-<br \/>\n2 dures for case management and development to af-<br \/>\n3 fect timely disposition of actions brought under this<br \/>\n4 Act; and<br \/>\n5 (6) develop a deconfliction process in consulta-<br \/>\n6 tion with other law enforcement agencies, including<br \/>\n7 the United States Immigration and Customs En-<br \/>\n8 forcement, to coordinate enforcement activities<br \/>\n9 brought under this Act.<br \/>\n10 (b) REPORTS.\u2014<br \/>\n11 (1) REPORT ON EFFECTIVENESS OF CERTAIN<br \/>\n12 MEASURES.\u2014Not later than 1 year after the date of<br \/>\n13 enactment of this Act, the Secretary of Commerce,<br \/>\n14 in coordination with the Attorney General, the Sec-<br \/>\n15 retary of Homeland Security, and the Intellectual<br \/>\n16 Property Enforcement Coordinator, shall conduct a<br \/>\n17 study and report to the Committee on the Judiciary<br \/>\n18 of the Senate and the Committee on the Judiciary<br \/>\n19 of the House of Representatives on the following:<br \/>\n20 (A) An assessment of the effects, if any, of<br \/>\n21 the implementation of section 3(d)(2)(A) on the<br \/>\n22 accessibility of Internet sites dedicated to in-<br \/>\n23 fringing activity.<br \/>\n24 (B) An assessment of the effects, if any, of<br \/>\n25 the implementation of section 3(d)(2)(A) on the<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00029 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS30<br \/>\n\u2022S 968 RS<br \/>\n1 deployment, security, and reliability of the do-<br \/>\n2 main name system and associated Internet<br \/>\n3 processes, including Domain Name System Se-<br \/>\n4 curity Extensions.<br \/>\n5 (C) Recommendations, if any, for modi-<br \/>\n6 fying or amending this Act to increase effective-<br \/>\n7 ness or ameliorate any unintended effects of<br \/>\n8 section 3(d)(2)(A).<br \/>\n9 (2) REPORT ON OVERALL EFFECTIVENESS.\u2014<br \/>\n10 The Register of Copyrights shall, in consultation<br \/>\n11 with the appropriate departments and agencies of<br \/>\n12 the United States and other stakeholders\u2014<br \/>\n13 (A) conduct a study on\u2014<br \/>\n14 (i) the enforcement and effectiveness<br \/>\n15 of this Act; and<br \/>\n16 (ii) the need to modify or amend this<br \/>\n17 Act to apply to emerging technologies; and<br \/>\n18 (B) not later than 2 years after the date<br \/>\n19 of enactment of this Act, submit a report to the<br \/>\n20 Committee on the Judiciary of the Senate and<br \/>\n21 the Committee on the Judiciary of the House of<br \/>\n22 Representatives on\u2014<br \/>\n23 (i) the results of the study conducted<br \/>\n24 under subparagraph (A); and<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00030 Fmt 6652 Sfmt 6401 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS31<br \/>\n\u2022S 968 RS<br \/>\n1 (ii) any recommendations that the<br \/>\n2 Register may have as a result of the study.<br \/>\n3 SECTION 1. SHORT TITLE.<br \/>\n4 This Act may be cited as the \u2018\u2018Preventing Real Online<br \/>\n5 Threats to Economic Creativity and Theft of Intellectual<br \/>\n6 Property Act of 2011\u2019\u2019 or the \u2018\u2018PROTECT IP Act of 2011\u2019\u2019.<br \/>\n7 SEC. 2. DEFINITIONS.<br \/>\n8 For purposes of this Act\u2014<br \/>\n9 (1) the term \u2018\u2018domain name\u2019\u2019 has the same mean-<br \/>\n10 ing as in section 45 of the Lanham Act (15 U.S.C.<br \/>\n11 1127);<br \/>\n12 (2) the term \u2018\u2018domain name system server\u2019\u2019<br \/>\n13 means a server or other mechanism used to provide<br \/>\n14 the Internet protocol address associated with a do-<br \/>\n15 main name;<br \/>\n16 (3) the term \u2018\u2018financial transaction provider\u2019\u2019<br \/>\n17 has the same meaning as in section 5362(4) of title<br \/>\n18 31, United States Code;<br \/>\n19 (4) the term \u2018\u2018information location tool\u2019\u2019 has the<br \/>\n20 same meaning as described in subsection (d) of sec-<br \/>\n21 tion 512 of title 17, United States Code;<br \/>\n22 (5) the term \u2018\u2018Internet advertising service\u2019\u2019<br \/>\n23 means a service that for compensation sells, pur-<br \/>\n24 chases, brokers, serves, inserts, verifies, or clears the<br \/>\n25 placement of an advertisement, including a paid or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00031 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS32<br \/>\n\u2022S 968 RS<br \/>\n1 sponsored search result, link, or placement that is<br \/>\n2 rendered in viewable form for any period of time on<br \/>\n3 an Internet site;<br \/>\n4 (6) the term \u2018\u2018Internet site\u2019\u2019 means the collection<br \/>\n5 of digital assets, including links, indexes, or pointers<br \/>\n6 to digital assets, accessible through the Internet that<br \/>\n7 are addressed relative to a common domain name;<br \/>\n8 (7) the term \u2018\u2018Internet site dedicated to infring-<br \/>\n9 ing activities\u2019\u2019 means an Internet site that\u2014<br \/>\n10 (A) has no significant use other than engag-<br \/>\n11 ing in, enabling, or facilitating the\u2014<br \/>\n12 (i) reproduction, distribution, or public<br \/>\n13 performance of copyrighted works, in com-<br \/>\n14 plete or substantially complete form, in a<br \/>\n15 manner that constitutes copyright infringe-<br \/>\n16 ment under section 501 of title 17, United<br \/>\n17 States Code;<br \/>\n18 (ii) violation of section 1201 of title<br \/>\n19 17, United States Code; or<br \/>\n20 (iii) sale, distribution, or promotion of<br \/>\n21 goods, services, or materials bearing a coun-<br \/>\n22 terfeit mark, as that term is defined in sec-<br \/>\n23 tion 34(d) of the Lanham Act; or<br \/>\n24 (B) is designed, operated, or marketed by its<br \/>\n25 operator or persons operating in concert with the<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00032 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS33<br \/>\n\u2022S 968 RS<br \/>\n1 operator, and facts or circumstances suggest is<br \/>\n2 used, primarily as a means for engaging in, ena-<br \/>\n3 bling, or facilitating the activities described<br \/>\n4 under clauses (i), (ii), or (iii) of subparagraph<br \/>\n5 (A);<br \/>\n6 (8) the term \u2018\u2018Lanham Act\u2019\u2019 means the Act enti-<br \/>\n7 tled \u2018\u2018An Act to provide for the registration and pro-<br \/>\n8 tection of trademarks used in commerce, to carry out<br \/>\n9 the provisions of certain international conventions,<br \/>\n10 and for other purposes\u2019\u2019, approved July 5, 1946 (com-<br \/>\n11 monly referred to as the \u2018\u2018Trademark Act of 1946\u2019\u2019 or<br \/>\n12 the \u2018\u2018Lanham Act\u2019\u2019);<br \/>\n13 (9) the term \u2018\u2018nondomestic domain name\u2019\u2019 means<br \/>\n14 a domain name for which the domain name registry<br \/>\n15 that issued the domain name and operates the rel-<br \/>\n16 evant top level domain, and the domain name reg-<br \/>\n17 istrar for the domain name, are not located in the<br \/>\n18 United States;<br \/>\n19 (10) the term \u2018\u2018owner\u2019\u2019 or \u2018\u2018operator\u2019\u2019 when used<br \/>\n20 in connection with an Internet site shall include, re-<br \/>\n21 spectively, any owner of a majority interest in, or<br \/>\n22 any person with authority to operate, such Internet<br \/>\n23 site; and<br \/>\n24 (11) the term \u2018\u2018qualifying plaintiff\u2019\u2019 means\u2014<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00033 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS34<br \/>\n\u2022S 968 RS<br \/>\n1 (A) the Attorney General of the United<br \/>\n2 States; or<br \/>\n3 (B) an owner of an intellectual property<br \/>\n4 right, or one authorized to enforce such right,<br \/>\n5 harmed by the activities of an Internet site dedi-<br \/>\n6 cated to infringing activities occurring on that<br \/>\n7 Internet site.<br \/>\n8 SEC. 3. ENHANCING ENFORCEMENT AGAINST ROGUE<br \/>\n9 WEBSITES OPERATED AND REGISTERED<br \/>\n10 OVERSEAS.<br \/>\n11 (a) COMMENCEMENT OF AN ACTION.\u2014<br \/>\n12 (1) IN PERSONAM.\u2014The Attorney General may<br \/>\n13 commence an in personam action against\u2014<br \/>\n14 (A) a registrant of a nondomestic domain<br \/>\n15 name used by an Internet site dedicated to in-<br \/>\n16 fringing activities; or<br \/>\n17 (B) an owner or operator of an Internet site<br \/>\n18 dedicated to infringing activities accessed<br \/>\n19 through a nondomestic domain name.<br \/>\n20 (2) IN REM.\u2014If through due diligence the Attor-<br \/>\n21 ney General is unable to find a person described in<br \/>\n22 subparagraphs (A) or (B) of paragraph (1), or no<br \/>\n23 such person found has an address within a judicial<br \/>\n24 district of the United States, the Attorney General<br \/>\n25 may commence an in rem action against a nonVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00034 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS35<br \/>\n\u2022S 968 RS<br \/>\n1 domestic domain name used by an Internet site dedi-<br \/>\n2 cated to infringing activities.<br \/>\n3 (3) IDENTIFICATION OF ENTITIES.\u2014Any action<br \/>\n4 commenced by the Attorney General under this sec-<br \/>\n5 tion shall identify the entities which may be required<br \/>\n6 to take actions pursuant to subsection (d) if an order<br \/>\n7 issues pursuant to subsection (b).<br \/>\n8 (b) ORDERS OF THE COURT.\u2014<br \/>\n9 (1) IN GENERAL.\u2014On application of the Attor-<br \/>\n10 ney General following the commencement of an action<br \/>\n11 under this section, the court may issue a temporary<br \/>\n12 restraining order, a preliminary injunction, or an in-<br \/>\n13 junction, in accordance with rule 65 of the Federal<br \/>\n14 Rules of Civil Procedure, against the nondomestic do-<br \/>\n15 main name used by an Internet site dedicated to in-<br \/>\n16 fringing activities, or against a registrant of such do-<br \/>\n17 main name, or the owner or operator of such Internet<br \/>\n18 site dedicated to infringing activities, to cease and de-<br \/>\n19 sist from undertaking any further activity as an<br \/>\n20 Internet site dedicated to infringing activities, if\u2014<br \/>\n21 (A) the domain name is used within the<br \/>\n22 United States to access such Internet site; and<br \/>\n23 (B) the Internet site\u2014<br \/>\n24 (i) conducts business directed to resi-<br \/>\n25 dents of the United States; and<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00035 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS36<br \/>\n\u2022S 968 RS<br \/>\n1 (ii) harms holders of United States in-<br \/>\n2 tellectual property rights.<br \/>\n3 (2) DETERMINATION BY THE COURT.\u2014For pur-<br \/>\n4 poses of determining whether an Internet site con-<br \/>\n5 ducts business directed to residents of the United<br \/>\n6 States under paragraph (1)(B)(i), a court may con-<br \/>\n7 sider, among other indicia, whether\u2014<br \/>\n8 (A) the Internet site is providing goods or<br \/>\n9 services described in section 2(7) to users located<br \/>\n10 in the United States;<br \/>\n11 (B) there is evidence that the Internet site<br \/>\n12 is not intended to provide\u2014<br \/>\n13 (i) such goods and services to users lo-<br \/>\n14 cated in the United States;<br \/>\n15 (ii) access to such goods and services to<br \/>\n16 users located in the United States; and<br \/>\n17 (iii) delivery of such goods and services<br \/>\n18 to users located in the United States;<br \/>\n19 (C) the Internet site has reasonable meas-<br \/>\n20 ures in place to prevent such goods and services<br \/>\n21 from being accessed from or delivered to the<br \/>\n22 United States;<br \/>\n23 (D) the Internet site offers services obtained<br \/>\n24 in the United States; and<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00036 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS37<br \/>\n\u2022S 968 RS<br \/>\n1 (E) any prices for goods and services are<br \/>\n2 indicated in the currency of the United States.<br \/>\n3 (c) NOTICE AND SERVICE OF PROCESS.\u2014<br \/>\n4 (1) IN GENERAL.\u2014Upon commencing an action<br \/>\n5 under this section, the Attorney General shall send a<br \/>\n6 notice of the alleged violation and intent to proceed<br \/>\n7 under this Act to the registrant of the domain name<br \/>\n8 of the Internet site\u2014<br \/>\n9 (A) at the postal and e-mail address ap-<br \/>\n10 pearing in the applicable publicly accessible<br \/>\n11 database of registrations, if any and to the ex-<br \/>\n12 tent such addresses are reasonably available;<br \/>\n13 (B) via the postal and e-mail address of the<br \/>\n14 registrar, registry, or other domain name reg-<br \/>\n15 istration authority that registered or assigned<br \/>\n16 the domain name, to the extent such addresses<br \/>\n17 are reasonably available; and<br \/>\n18 (C) in any other such form as the court<br \/>\n19 finds necessary, including as may be required by<br \/>\n20 Rule 4(f) of the Federal Rules of Civil Procedure.<br \/>\n21 (2) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n22 this section, the actions described in this subsection<br \/>\n23 shall constitute service of process.<br \/>\n24 (3) OTHER NOTICE.\u2014Upon commencing an ac-<br \/>\n25 tion under this section, the Attorney General shall<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00037 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS38<br \/>\n\u2022S 968 RS<br \/>\n1 also provide notice to entities identified in the com-<br \/>\n2 plaint, or any amendments thereto, which may be re-<br \/>\n3 quired to take action pursuant to subsection (d).<br \/>\n4 (d) REQUIRED ACTIONS BASED ON COURT ORDERS.\u2014<br \/>\n5 (1) SERVICE.\u2014A Federal law enforcement offi-<br \/>\n6 cer, with the prior approval of the court, may serve<br \/>\n7 a copy of a court order issued pursuant to this section<br \/>\n8 on similarly situated entities within each class de-<br \/>\n9 scribed in paragraph (2), which have been identified<br \/>\n10 in the complaint, or any amendments thereto, pursu-<br \/>\n11 ant to subsection (a). Proof of service shall be filed<br \/>\n12 with the court.<br \/>\n13 (2) REASONABLE MEASURES.\u2014After being served<br \/>\n14 with a copy of an order pursuant to this subsection:<br \/>\n15 (A) OPERATORS.\u2014<br \/>\n16 (i) IN GENERAL.\u2014An operator of a<br \/>\n17 nonauthoritative domain name system serv-<br \/>\n18 er shall take the least burdensome tech-<br \/>\n19 nically feasible and reasonable measures de-<br \/>\n20 signed to prevent the domain name de-<br \/>\n21 scribed in the order from resolving to that<br \/>\n22 domain name\u2019s Internet protocol address,<br \/>\n23 except that\u2014<br \/>\n24 (I) such operator shall not be re-<br \/>\n25 quired\u2014<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00038 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS39<br \/>\n\u2022S 968 RS<br \/>\n1 (aa) other than as directed<br \/>\n2 under this subparagraph, to mod-<br \/>\n3 ify its network, software, systems,<br \/>\n4 or facilities;<br \/>\n5 (bb) to take any measures<br \/>\n6 with respect to domain name<br \/>\n7 lookups not performed by its own<br \/>\n8 domain name server or domain<br \/>\n9 name system servers located out-<br \/>\n10 side the United States; or<br \/>\n11 (cc) to continue to prevent<br \/>\n12 access to a domain name to which<br \/>\n13 access has been effectively disable<br \/>\n14 by other means; and<br \/>\n15 (II) nothing in this subparagraph<br \/>\n16 shall affect the limitation on the liabil-<br \/>\n17 ity of such an operator under section<br \/>\n18 512 of title 17, United States Code.<br \/>\n19 (ii) TEXT OF NOTICE.\u2014The Attorney<br \/>\n20 General shall prescribe the text of the notice<br \/>\n21 displayed to users or customers of an oper-<br \/>\n22 ator taking an action pursuant to this sub-<br \/>\n23 paragraph. Such text shall specify that the<br \/>\n24 action is being taken pursuant to a court<br \/>\n25 order obtained by the Attorney General.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00039 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS40<br \/>\n\u2022S 968 RS<br \/>\n1 (B) FINANCIAL TRANSACTION PROVIDERS.\u2014<br \/>\n2 A financial transaction provider shall take rea-<br \/>\n3 sonable measures, as expeditiously as reasonable,<br \/>\n4 designed to prevent, prohibit, or suspend its serv-<br \/>\n5 ice from completing payment transactions in-<br \/>\n6 volving customers located within the United<br \/>\n7 States and the Internet site associated with the<br \/>\n8 domain name set forth in the order.<br \/>\n9 (C) INTERNET ADVERTISING SERVICES.\u2014An<br \/>\n10 Internet advertising service that contracts with<br \/>\n11 the Internet site associated with the domain<br \/>\n12 name set forth in the order to provide adver-<br \/>\n13 tising to or for that site, or which knowingly<br \/>\n14 serves advertising to or for such site, shall take<br \/>\n15 technically feasible and reasonable measures, as<br \/>\n16 expeditiously as reasonable, designed to\u2014<br \/>\n17 (i) prevent its service from providing<br \/>\n18 advertisements to the Internet site associ-<br \/>\n19 ated with such domain name; or<br \/>\n20 (ii) cease making available advertise-<br \/>\n21 ments for that site, or paid or sponsored<br \/>\n22 search results, links or other placements<br \/>\n23 that provide access to the domain name.<br \/>\n24 (D) INFORMATION LOCATION TOOLS.\u2014An<br \/>\n25 service provider of an information location tool<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00040 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS41<br \/>\n\u2022S 968 RS<br \/>\n1 shall take technically feasible and reasonable<br \/>\n2 measures, as expeditiously as possible, to\u2014<br \/>\n3 (i) remove or disable access to the<br \/>\n4 Internet site associated with the domain<br \/>\n5 name set forth in the order; or<br \/>\n6 (ii) not serve a hypertext link to such<br \/>\n7 Internet site.<br \/>\n8 (3) COMMUNICATION WITH USERS.\u2014Except as<br \/>\n9 provided under paragraph (2)(A)(ii), an entity tak-<br \/>\n10 ing an action described in this subsection shall deter-<br \/>\n11 mine whether and how to communicate such action to<br \/>\n12 the entity\u2019s users or customers.<br \/>\n13 (4) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n14 an action commenced under this section, the obliga-<br \/>\n15 tions of an entity described in this subsection shall be<br \/>\n16 limited to the actions set out in each paragraph or<br \/>\n17 subparagraph applicable to such entity, and no order<br \/>\n18 issued pursuant to this section shall impose any addi-<br \/>\n19 tional obligations on, or require additional actions<br \/>\n20 by, such entity.<br \/>\n21 (5) ACTIONS PURSUANT TO COURT ORDER.\u2014<br \/>\n22 (A) IMMUNITY FROM SUIT.\u2014No cause of ac-<br \/>\n23 tion shall lie in any Federal or State court or<br \/>\n24 administrative agency against any entity receiv-<br \/>\n25 ing a court order issued under this subsection, or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00041 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS42<br \/>\n\u2022S 968 RS<br \/>\n1 against any director, officer, employee, or agent<br \/>\n2 thereof, for any act reasonably designed to com-<br \/>\n3 ply with this subsection or reasonably arising<br \/>\n4 from such order, other than in an action pursu-<br \/>\n5 ant to subsection (e).<br \/>\n6 (B) IMMUNITY FROM LIABILITY.\u2014Any enti-<br \/>\n7 ty receiving an order under this subsection, and<br \/>\n8 any director, officer, employee, or agent thereof,<br \/>\n9 shall not be liable to any party for any acts rea-<br \/>\n10 sonably designed to comply with this subsection<br \/>\n11 or reasonably arising from such order, other<br \/>\n12 than in an action pursuant to subsection (e),<br \/>\n13 and any actions taken by customers of such enti-<br \/>\n14 ty to circumvent any restriction on access to the<br \/>\n15 Internet domain instituted pursuant to this sub-<br \/>\n16 section or any act, failure, or inability to restrict<br \/>\n17 access to an Internet domain that is the subject<br \/>\n18 of a court order issued pursuant to this sub-<br \/>\n19 section despite good faith efforts to do so by such<br \/>\n20 entity shall not be used by any person in any<br \/>\n21 claim or cause of action against such entity,<br \/>\n22 other than in an action pursuant to subsection<br \/>\n23 (e).<br \/>\n24 (e) ENFORCEMENT OF ORDERS.\u2014<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00042 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS43<br \/>\n\u2022S 968 RS<br \/>\n1 (1) IN GENERAL.\u2014In order to compel compliance<br \/>\n2 with this section, the Attorney General may bring an<br \/>\n3 action for injunctive relief against any party receiv-<br \/>\n4 ing a court order issued pursuant to this section that<br \/>\n5 knowingly and willfully fails to comply with such<br \/>\n6 order.<br \/>\n7 (2) RULE OF CONSTRUCTION.\u2014The authority<br \/>\n8 granted the Attorney General under paragraph (1)<br \/>\n9 shall be the sole legal remedy for enforcing the obliga-<br \/>\n10 tions under this section of any entity described in<br \/>\n11 subsection (d).<br \/>\n12 (3) DEFENSE.\u2014A defendant in an action under<br \/>\n13 paragraph (1) may establish an affirmative defense<br \/>\n14 by showing that the defendant does not have the tech-<br \/>\n15 nical means to comply with the subsection without in-<br \/>\n16 curring an unreasonable economic burden, or that the<br \/>\n17 order is inconsistent with this Act. This showing shall<br \/>\n18 serve as a defense only to the extent of such inability<br \/>\n19 to comply or to the extent of such inconsistency.<br \/>\n20 (f) MODIFICATION OR VACATION OF ORDERS.\u2014<br \/>\n21 (1) IN GENERAL.\u2014At any time after the issuance<br \/>\n22 of an order under subsection (b), a motion to modify,<br \/>\n23 suspend, or vacate the order may be filed by\u2014<br \/>\n24 (A) any person, or owner or operator of<br \/>\n25 property, bound by the order;<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00043 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS44<br \/>\n\u2022S 968 RS<br \/>\n1 (B) any registrant of the domain name, or<br \/>\n2 the owner or operator of the Internet site subject<br \/>\n3 to the order;<br \/>\n4 (C) any domain name registrar or registry<br \/>\n5 that has registered or assigned the domain name<br \/>\n6 of the Internet site subject to the order; or<br \/>\n7 (D) any entity that has received a copy of<br \/>\n8 an order pursuant to subsection (d) requiring<br \/>\n9 such entity to take action prescribed in that sub-<br \/>\n10 section.<br \/>\n11 (2) RELIEF.\u2014Relief under this subsection shall<br \/>\n12 be proper if the court finds that\u2014<br \/>\n13 (A) the Internet site associated with the do-<br \/>\n14 main name subject to the order is no longer, or<br \/>\n15 never was, an Internet site dedicated to infring-<br \/>\n16 ing activities; or<br \/>\n17 (B) the interests of justice require that the<br \/>\n18 order be modified, suspended, or vacated.<br \/>\n19 (3) CONSIDERATION.\u2014In making a relief deter-<br \/>\n20 mination under paragraph (2), a court may consider<br \/>\n21 whether the domain name has expired or has been re-<br \/>\n22 registered by a different party.<br \/>\n23 (4) INTERVENTION.\u2014An entity identified pursu-<br \/>\n24 ant to subsection (a) as an entity which may be re-<br \/>\n25 quired to take action pursuant to subsection (d) if an<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00044 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS45<br \/>\n\u2022S 968 RS<br \/>\n1 order issues pursuant to subsection (b) may intervene<br \/>\n2 at any time in any action commenced under sub-<br \/>\n3 section (a), or in any action to modify, suspend, or<br \/>\n4 vacate an order pursuant to this subsection. Failure<br \/>\n5 to intervene in an action does not prohibit an entity<br \/>\n6 notified of the action from subsequently seeking an<br \/>\n7 order to modify, suspend, or terminate an order<br \/>\n8 issued by the court under this Act.<br \/>\n9 (g) RELATED ACTIONS.\u2014The Attorney General, if al-<br \/>\n10 leging that an Internet site previously adjudicated to be an<br \/>\n11 Internet site dedicated to infringing activities is accessible<br \/>\n12 or has been reconstituted at a different domain name, may<br \/>\n13 commence a related action under this section against the<br \/>\n14 additional domain name in the same judicial district as<br \/>\n15 the previous action.<br \/>\n16 SEC. 4. ELIMINATING THE FINANCIAL INCENTIVE TO STEAL<br \/>\n17 INTELLECTUAL PROPERTY ONLINE.<br \/>\n18 (a) COMMENCEMENT OF AN ACTION.\u2014<br \/>\n19 (1) IN PERSONAM.\u2014A qualifying plaintiff may<br \/>\n20 commence an in personam action against\u2014<br \/>\n21 (A) a registrant of a domain name used by<br \/>\n22 an Internet site dedicated to infringing activi-<br \/>\n23 ties; or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00045 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS46<br \/>\n\u2022S 968 RS<br \/>\n1 (B) an owner or operator of an Internet site<br \/>\n2 dedicated to infringing activities accessed<br \/>\n3 through a domain name.<br \/>\n4 (2) IN REM.\u2014If through due diligence a quali-<br \/>\n5 fying plaintiff is unable to find a person described in<br \/>\n6 subparagraphs (A) or (B) of paragraph (1), or no<br \/>\n7 such person found has an address within a judicial<br \/>\n8 district of the United States, the qualifying plaintiff<br \/>\n9 may commence an in rem action against a domain<br \/>\n10 name used by an Internet site dedicated to infringing<br \/>\n11 activities.<br \/>\n12 (3) IDENTIFICATION OF ENTITIES.\u2014Any action<br \/>\n13 commenced by a qualifying plaintiff under this sec-<br \/>\n14 tion shall identify the entities which may be required<br \/>\n15 to take actions pursuant to subsection (d) if an order<br \/>\n16 issues pursuant to subsection (b).<br \/>\n17 (b) ORDERS OF THE COURT.\u2014<br \/>\n18 (1) IN GENERAL.\u2014On application of a quali-<br \/>\n19 fying plaintiff following the commencement of an ac-<br \/>\n20 tion under this section, the court may issue a tem-<br \/>\n21 porary restraining order, a preliminary injunction,<br \/>\n22 or an injunction, in accordance with rule 65 of the<br \/>\n23 Federal Rules of Civil Procedure, against the domain<br \/>\n24 name used by an Internet site dedicated to infringing<br \/>\n25 activities, or against a registrant of such domain<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00046 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS47<br \/>\n\u2022S 968 RS<br \/>\n1 name, or the owner or operator of such Internet site<br \/>\n2 dedicated to infringing activities, to cease and desist<br \/>\n3 from undertaking any further activity as an Internet<br \/>\n4 site dedicated to infringing activities, if\u2014<br \/>\n5 (A) the domain name is registered or as-<br \/>\n6 signed by a domain name registrar or domain<br \/>\n7 name registry that located or doing business in<br \/>\n8 the United States; or<br \/>\n9 (B)(i) the domain name is used within the<br \/>\n10 United States to access such Internet site; and<br \/>\n11 (ii) the Internet site\u2014<br \/>\n12 (I) conducts business directed to resi-<br \/>\n13 dents of the United States; and<br \/>\n14 (II) harms holders of United States in-<br \/>\n15 tellectual property rights.<br \/>\n16 (2) DETERMINATION BY THE COURT.\u2014For pur-<br \/>\n17 poses of determining whether an Internet site con-<br \/>\n18 ducts business directed to residents of the United<br \/>\n19 States under paragraph (1)(B)(ii)(I), a court may<br \/>\n20 consider, among other indicia, whether\u2014<br \/>\n21 (A) the Internet site is providing goods or<br \/>\n22 services described in section 2(7) to users located<br \/>\n23 in the United States;<br \/>\n24 (B) there is evidence that the Internet site<br \/>\n25 is not intended to provide\u2014<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00047 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS48<br \/>\n\u2022S 968 RS<br \/>\n1 (i) such goods and services to users lo-<br \/>\n2 cated in the United States;<br \/>\n3 (ii) access to such goods and services to<br \/>\n4 users located in the United States; and<br \/>\n5 (iii) delivery of such goods and services<br \/>\n6 to users located in the United States;<br \/>\n7 (C) the Internet site has reasonable meas-<br \/>\n8 ures in place to prevent such goods and services<br \/>\n9 from being accessed from or delivered to the<br \/>\n10 United States;<br \/>\n11 (D) the Internet site offers services obtained<br \/>\n12 in the United States; and<br \/>\n13 (E) any prices for goods and services are<br \/>\n14 indicated in the currency of the United States.<br \/>\n15 (c) NOTICE AND SERVICE OF PROCESS.\u2014<br \/>\n16 (1) IN GENERAL.\u2014Upon commencing an action<br \/>\n17 under this section, the qualifying plaintiff shall send<br \/>\n18 a notice of the alleged violation and intent to proceed<br \/>\n19 under this Act to the registrant of the domain name<br \/>\n20 of the Internet site\u2014<br \/>\n21 (A) at the postal and e-mail address ap-<br \/>\n22 pearing in the applicable publicly accessible<br \/>\n23 database of registrations, if any and to the ex-<br \/>\n24 tent such addresses are reasonably available;<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00048 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS49<br \/>\n\u2022S 968 RS<br \/>\n1 (B) via the postal and e-mail address of the<br \/>\n2 registrar, registry, or other domain name reg-<br \/>\n3 istration authority that registered or assigned<br \/>\n4 the domain name, to the extent such addresses<br \/>\n5 are reasonably available; and<br \/>\n6 (C) in any other such form as the court<br \/>\n7 finds necessary, including as may be required by<br \/>\n8 Rule 4(f) of the Federal Rules of Civil Procedure.<br \/>\n9 (2) RULE OF CONSTRUCTION.\u2014For purposes of<br \/>\n10 this section, the actions described in this subsection<br \/>\n11 shall constitute service of process.<br \/>\n12 (3) OTHER NOTICE.\u2014Upon commencing an ac-<br \/>\n13 tion under this section, the qualifying plaintiff shall<br \/>\n14 also provide notice to entities identified in the com-<br \/>\n15 plaint, or any amendments thereto, which may be re-<br \/>\n16 quired to take action pursuant to subsection (d).<br \/>\n17 (d) REQUIRED ACTIONS BASED ON COURT ORDERS.\u2014<br \/>\n18 (1) SERVICE.\u2014A qualifying plaintiff, with the<br \/>\n19 prior approval of the court, may, serve a copy of a<br \/>\n20 court order issued pursuant to this section on simi-<br \/>\n21 larly situated entities within each class described in<br \/>\n22 paragraph (2), which have been identified in the com-<br \/>\n23 plaint, or any amendments thereto, pursuant to sub-<br \/>\n24 section (a). Proof of service shall be filed with the<br \/>\n25 court.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00049 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS50<br \/>\n\u2022S 968 RS<br \/>\n1 (2) REASONABLE MEASURES.\u2014After being served<br \/>\n2 with a copy of an order pursuant to this subsection:<br \/>\n3 (A) FINANCIAL TRANSACTION PROVIDERS.\u2014<br \/>\n4 A financial transaction provider shall take rea-<br \/>\n5 sonable measures, as expeditiously as reasonable,<br \/>\n6 designed to prevent, prohibit, or suspend its serv-<br \/>\n7 ice from completing payment transactions in-<br \/>\n8 volving customers located within the United<br \/>\n9 States and the Internet site associated with the<br \/>\n10 domain name set forth in the order.<br \/>\n11 (B) INTERNET ADVERTISING SERVICES.\u2014An<br \/>\n12 Internet advertising service that contracts with<br \/>\n13 the Internet site associated with the domain<br \/>\n14 name set forth in the order to provide adver-<br \/>\n15 tising to or for that site, or which knowingly<br \/>\n16 serves advertising to or for such site, shall take<br \/>\n17 technically feasible and reasonable measures, as<br \/>\n18 expeditiously as reasonable, designed to\u2014<br \/>\n19 (i) prevent its service from providing<br \/>\n20 advertisements to the Internet site associ-<br \/>\n21 ated with such domain name; SAVINGS CLAUSES.<br \/>\n19 (a) RULE OF CONSTRUCTION RELATING TO CIVIL AND<br \/>\n20 CRIMINAL REMEDIES.\u2014Nothing in this Act shall be con-<br \/>\n21 strued to limit or expand civil or criminal remedies avail-<br \/>\n22 able to any person (including the United States) for in-<br \/>\n23 fringing activities on the Internet pursuant to any other<br \/>\n24 Federal or State law.<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00057 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS58<br \/>\n\u2022S 968 RS<br \/>\n1 (b) RULE OF CONSTRUCTION RELATING TO VICARIOUS<br \/>\n2 OR CONTRIBUTORY LIABILITY.\u2014Nothing in this Act shall<br \/>\n3 be construed to enlarge or diminish vicarious or contribu-<br \/>\n4 tory liability for any cause of action available under the<br \/>\n5 Lanham Act or title 17, United States Code, including any<br \/>\n6 limitations on liability under section 512 of such title 17,<br \/>\n7 or to create an obligation to take action pursuant to section<br \/>\n8 5 of this Act.<br \/>\n9 (c) RELATIONSHIP WITH SECTION 512 OF TITLE 17.\u2014<br \/>\n10 Nothing in this Act, no identification of entities in section<br \/>\n11 3(a) or 4(a), no notice provided pursuant to section 3(c)<br \/>\n12 or 4(c), no order issued pursuant to sections 3(b) or 4(b),<br \/>\n13 and no order issued or served pursuant to sections 3(d) or<br \/>\n14 4(d), shall serve as a basis for determining the application<br \/>\n15 of section 512 of title 17, United States Code.<br \/>\n16 SEC. 7. GUIDELINES AND STUDIES.<br \/>\n17 (a) GUIDELINES.\u2014The Attorney General shall\u2014<br \/>\n18 (1) publish procedures developed in consultation<br \/>\n19 with other relevant law enforcement agencies, includ-<br \/>\n20 ing the United States Immigration and Customs En-<br \/>\n21 forcement, to receive information from the public<br \/>\n22 about Internet sites dedicated to infringing activities;<br \/>\n23 and<br \/>\n24 (2) develop a deconfliction process in consulta-<br \/>\n25 tion with other law enforcement agencies, including<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00058 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS59<br \/>\n\u2022S 968 RS<br \/>\n1 the United States Immigration and Customs Enforce-<br \/>\n2 ment, to coordinate enforcement activities brought<br \/>\n3 under this Act.<br \/>\n4 (b) REPORTS.\u2014<br \/>\n5 (1) REPORT ON EFFECTIVENESS OF CERTAIN<br \/>\n6 MEASURES.\u2014Not later than 1 year after the date of<br \/>\n7 enactment of this Act, the Secretary of Commerce, in<br \/>\n8 coordination with the Attorney General, the Secretary<br \/>\n9 of Homeland Security, and the Intellectual Property<br \/>\n10 Enforcement Coordinator, shall conduct a study and<br \/>\n11 report to the Committee on the Judiciary of the Sen-<br \/>\n12 ate and the Committee on the Judiciary of the House<br \/>\n13 of Representatives on the following:<br \/>\n14 (A) An assessment of the effects, if any, of<br \/>\n15 the implementation of section 3(d)(2)(A) on the<br \/>\n16 accessibility of Internet sites dedicated to in-<br \/>\n17 fringing activity.<br \/>\n18 (B) An assessment of the effects, if any, of<br \/>\n19 the implementation of section 3(d)(2)(A) on the<br \/>\n20 deployment, security, and reliability of the do-<br \/>\n21 main name system and associated Internet proc-<br \/>\n22 esses, including Domain Name System Security<br \/>\n23 Extensions.<br \/>\n24 (C) Recommendations, if any, for modifying<br \/>\n25 or amending this Act to increase effectiveness or<br \/>\nVerDate Mar 15 2010 00:29 May 27, 2011 Jkt 099200 PO 00000 Frm 00059 Fmt 6652 Sfmt 6203 E:\\BILLS\\S968.RS S968<br \/>\nrfrederick on DSKD9S0YB1PROD with BILLS60<br \/>\n\u2022S 968 RS<br \/>\n1 ameliorate any unintended effects of section<br \/>\n2 3(d)(2)(A).<br \/>\n3 (2) REPORT ON OVERALL EFFECTIVENESS.\u2014The<br \/>\n4 Register of Copyrights shall, in consultation with the<br \/>\n5 appropriate departments and agencies of the United<br \/>\n6 States and other stakeholders\u2014<br \/>\n7 (A) conduct a study on\u2014<br \/>\n8 (i) the enforcement and effectiveness of<br \/>\n9 this Act;<br \/>\n10 (ii) the burden of carrying out the re-<br \/>\n11 quirements of this Act, if any, on inter-<br \/>\n12 mediaries;<br \/>\n13 (iii) the need for cost reimbursement<br \/>\n14 for intermediaries for carrying out the re-<br \/>\n15 quirements of this Act; and<br \/>\n16 (iv) the need to modify or amend this<br \/>\n17 Act to apply to emerging technologies; and<br \/>\n18 (B) not later than 2 years after the date of<br \/>\n19 enactment of this Act, submit a report to the<br \/>\n20 Committee on the Judiciary of the Senate and<br \/>\n21 the Committee on the Judiciary of the House of<br \/>\n22 Representatives on\u2014<br \/>\n23 (i) the results of the study conducted<br \/>\n24 under subparagraph (A);
